What is a Vietnam Police Clearance Certificate?
A Vietnam Police Clearance Certificate, criminal record, or in Vietnamese – “Phieu Ly lich tu phap” is a paper issued by agencies managing judicial record databases (provincial-level Justice Departments or National Center for Judicial Records), which proves whether an individual has or doesn’t have a criminal record, judgment or decision of the Court during their stay in Vietnam. It also proves whether an individual is currently banned from holding a position in an enterprise or establishment that has been declared bankrupt by the Court.
When do I require Vietnam Police Clearance Certificates?
According to the Law No. 28/2009/QH12 of June 17, 2009, on judicial records, there are two forms of police clearance certificates in Vietnam: No. 1 and No. 2.
The police check No. 1 is for Vietnamese citizens and foreigners who resided or are currently residing in Vietnam and want to get a Criminal Record for professional purposes such as job applications and work permits. This form is also required when state agencies, political organisations and socio-political organisations require the issuance of judicial record cards to serve the personnel management, business registration, establishment and management of enterprises or cooperatives.
The police check No. 2 states both spent and unspent convictions.
